The Kennedy Center announced that its 30th presentation of the Kennedy Center Honors would go to pianist Leon Fleisher, comedian Steve Martin, singer Diana Ross, director Martin Scorsese and musician Brian Wilson. The Center was opened to the public in 1971 and was envisioned as part of the National Cultural Center Act, which mandated that the independent, privately-funded institution would present a wide variety of both classical and contemporary performances, commission the creation of new artistic works, and undertake a variety of educational missions to increase awareness of the arts.

In a statement, Kennedy Center Chairman Stephen A. Schwarzman said that “with their extraordinary talent, creativity and perseverance, the five 2007 honorees have transformed the way we, as Americans, see, hear and feel the performing arts.”

Fleisher, 79, a member of the Peabody Institute‘s music faculty, is a pianist who lost use of his right hand in 1965 due to a neurological condition. He became an accomplished musician and conductor through the use of his left hand. At 67, he regained the use of his right hand. With the advent of Botox therapy, he was once more able to undertake two-hand performances in 2004, his first in four decades. “I’m very gratified by the fact that it’s an apolitical honor,” Fleisher said. “It is given by colleagues and professional people who are aware of what [an artist] has done, so it really is apolitical — and that much more of an honor.”

Martin, 62, a comedian who has written books and essays in addition to his acting and stand-up comedy career, rose to fame during his work on the American television program Saturday Night Live in the 1970’s. Schwarzman praised his work as that of a “renaissance comic whose talents wipe out the boundaries between artistic disciplines.” Martin responded to the honor saying, “I am grateful to the Kennedy Center for finally alleviating in me years of covetousness and trophy envy.”

Ross, 63, was a product of Detroit‘s Brewster-Douglass Projects when as a teeager she and friends Mary Wilson and Florence Ballardis formed The Supremes, a ground-breaking Motown act. She portrayed singer Billie Holiday in the 1972 film Lady Sings the Blues, which earned her an Oscar nomination and a Golden Globe award. “Diana Ross’ singular, instantly recognizable voice has spread romance and joy throughout the world,” said Schwarzman. Ross said she was “taken aback. It is a huge, huge honor and I am excited to be in this class of people.”

Scorsese, 64, is one of the most accomplished directors the United States ever produced, whose work includes Mean Streets, Taxi Driver, GoodFellas, Cape Fear, The Last Temptation of Christ and The Departed, for which he won a 2006 Academy Award for Best Director after being nominated eight times. Scorsese said, “I’m very honored to be receiving this recognition from the Kennedy Center and proud to be joining the company of the very distinguished individuals who have received this honor in years past.”

Wilson, 65, along with his brothers Dennis and Carl, formed the Beach Boys in 1961. They had a series of hits that included “Surfin’ U.S.A.” and “Wouldn’t It Be Nice.” Their 1966 album Pet Sounds is considered one of the most influential recordings in American music. “This is something so unexpected and I feel extremely fortunate to be in the company of such great artists,” said Wilson, who is currently on tour.

The Kennedy Center’s board of trustees is responsible for selecting honorees for “lifetime contributions to American culture through the performing arts.” Previous honorees, including Elton John and Steven Spielberg, also submitted recommendations. A wide variety of people were under consideration, including Emanuel Ax, Evgeny Kissin, Renee Fleming, Laurence Fishburne, Francis Ford Coppola, Melissa Etheridge and Kenny Chesney.

President Bush and first lady Laura Bush will attend the center’s presentation at its opera house on December 2, 2007, which will broadcast on December 26 on CBS.

A judge in Minneapolis, Minnesota, United States ruled that a boy, Daniel Hauser, has been medically neglected by his parents and must take chemotherapy and radiation therapy for his cancer against his will.

Medical professionals testifying at the proceedings said that Daniel’s cancer, Hodgkin’s lymphoma, has a 90% survival rate with modern treatment, but only a 10% chance of survival without it.

The judge declared that the ruling was because there was a “compelling state interest in the life and welfare of Daniel sufficient to override the fundamental constitutional rights of both the parents and Daniel to the free exercise of religion and the due process right of the parents to direct the religious and other upbringing of their child.” as noted in his 60 page verdict.

The boy lives in Sleepy Eye, Minnesota and his mother is a member of the Nemenhah, a Native American style group that opposes medical practices that it believes to “harm the body.”

His parents first brought him for one out of six chemotherapy treatments and then refused to have the rest. In an initial filing, Daniel said that he was a medicine man and he himself made the decision to refuse the chemotherapy. An important question in the case was whether Daniel truly made the decision to refuse treatment, or whether he was pressured by his parents.

A vital piece of evidence was presented by a Thomas Sinas, an attorney for the boy’s court appointed guardian who doubted Daniel’s religious beliefs. Daniel also gave closed door testimony to the judge. The statement was released, and stated that Daniel’s faith wasn’t genuine, that he was shaken by the effects of his aunt’s chemotherapy.

“This matter … involves a 13-year-old child who has only a rudimentary understanding at best of the risks and benefits of chemotherapy,” said Judge John Rodenberg, “He genuinely opposes the imposition of chemotherapy. However, he does not believe he is ill currently. The fact is that he is very ill currently.”

Daniel’s court-appointed defense attorney, Philip Elbert, said, “I feel it’s a blow to families, it marginalizes the decisions that parents face every day in regard to their children’s medical care. It really affirms the role that big government is better at making our decisions for us.”

Daniel’s parents will be required to give him a chest X-ray and proceed to give him chemotherapy and radiation therapy if a doctor says that they would still be effective. If they refuse to comply, Daniel will be taken into custody.

Daniel’s mother, Colleen Hauser, said, “If Daniel resists, it is a great question of how he will be treated. He may have to be sedated and that brings up the issue of forced treatment.”

The judge said that the court has a right to force treatment because Daniel does not understand his illness and the risks and benefits of therapy enough to create an informed consent.

O.J. Simpson has been arrested at the Palms Hotel and Casino on charges related to an alleged armed robbery on Thursday. Simpson is accused of taking items from memorabilia dealers at the Palace Station casino-hotel in Las Vegas. Simpson claims that the items belonged to him and were “things he hadn’t seen in years or that had been stolen.” Simpson denies guns were involved and that the incident was a robbery. The exact charges are currently unknown.

Two guns have been confiscated by the Las Vegas Metropolitan Police Department, as well as some of the sports memorabilia. Las Vegas police Lt. Nichols said the two guns were not registered to Simpson and were not in his possession when they were seized.

Yesterday, at this year’s Apple Worldwide Developers Conference (WWDC), company CEO Steve Jobs unveiled iPhone 4, along with the new iOS 4 operating system for Apple mobile devices.

The announcement was long-awaited but not a very big surprise. In April, the technology blog Gizmodo obtained a prototype of the new phone and published details of it online. While introducing iPhone 4, at the annual conference, Jobs started by hinting at the incident, saying, “Stop me if you’ve already seen this.”

The new iPhone was praised by Jobs as “the biggest leap we’ve taken since the original iPhone.” It is only 9.3 millimetres (0.37 inches) thick, making it “the thinnest smartphone on the planet”, a 24 percent reduction from Apple’s previous model, the iPhone 3GS. Structure-wise, iPhone 4 has a new stainless steel frame, which acts as an antenna, supposedly boosting its signal reception abilities and possibly reducing the amount of dropped calls. It also has a new screen, dubbed a “retina display,” which displays images at 326 pixels per inch. During the keynote, Jobs demoed the device’s new internal gyroscope as well. Even though it now uses Apple’s faster A4 processor (first used in its iPad tablet), iPhone 4 has a claimed seven hours of 3G talk time, up two hours from the 3GS.

In addition to its design features, Jobs showed off iPhone 4’s new video calling abilities. This feature is called FaceTime, and connects with other iPhone 4s via Wi-Fi. The phone has two cameras: one on the front for video chats, and one on the back for taking pictures and other videos. The rear camera has a resolution of five megapixels, is capable of recording high-definition video, and has an LED flash.

The iPhone 4 will use Apple’s latest mobile operating system, iOS 4. Formerly “iPhone OS,” iOS 4 was first introduced by Apple in April, and includes multitasking capabilities. Jobs called the new software “the most advanced mobile operating system in the world.” iOS will support Apple’s new mobile advertising service, iAd, which goes live on July 1.

iPhone 4 will be available on June 24 in the United States, United Kingdom, France, Germany, and Japan. It comes in two colors—black and white—and two storage capacities. The 16GB version is priced at US$199 and the 32GB version at US$299. The iPhone 3GS’s price will be reduced to US$99, and the iPhone 3G will be discontinued. iOS will be available as a free software update to users of compatible older Apple devices (including the 3GS) on June 21. In the U.S., iPhone 4 will only be available on AT&T’s cellular network, despite calls for Apple to let the iPhone be used on other carriers, such as Verizon.

Competition-wise, the BlackBerry mobile device is still the most popular smartphone right now. Apple is also facing some serious competition from web giant Google’s Android operating system, as well as Palm’s webOS. Earlier this year, Android phones managed to outsell iPhones. iPhone users, however, account for over half of those surfing the Internet on a mobile browser in the U.S. Jobs also noted that over five billion iOS applications, commonly called “apps,” have been purchased from Apple’s App Store. The App Store currently has around 225,000 different apps for sale.

Toyota announced on Friday that it will recall around 17,000 Lexus vehicles in response to risks of the fuel tank in the cars leaking after a collision.

The Lexus HS 250h model was subjected to the recall following a US National Highway Traffic Safety Administration (NHTSA) investigation. Despite previously passing Toyota safety inspections, the conclusions of an NHTSA sub-contracted investigator were that; when the vehicles in question collided with an object at more than fifty-miles-per hour, more than 142 grams of fuel, the maximum allowed by US law, leaked from the crashed car.

According to Toyota, further tests did not show any additional failure of the fuel tank.

In response to the findings, Toyota issued a recall of all affected vehicles, since the company had no solution immediately available. The recall includes 13,000 cars already sold, as well as another 4,000 still at dealerships.

Toyota says it plans to conduct further tests to determine the cause of the leak. A Toyota spokesman, Brian Lyons, said that the company was “still working to determine what the root cause of the condition is.” It’s still unclear when exactly the recall will take place, or when dealerships will be allowed to sell this model again. Lyons said that Toyota is “working feverishly to get this resolved as soon as possible.”

Toyota isn’t aware of any accidents stemming from the leaking fuel tank in the affected vehicles, first introduced in the summer of 2009.

The implosion of a relationship between Wikipedia founder Jimmy Wales and journalist Rachel Marsden has resulted in controversy and international headlines. Associated Press and ABC News have also reported on questionable activity by Wales involving Wikimedia Foundation expenses. The Wikimedia Foundation is a donor-supported non-profit organization which runs Wikipedia.

Marsden had contacted Wales two years ago about concerns she had over the article about her on Wikipedia, and Wales determined the article was not compliant with Wikipedia’s standards. The tech blog Valleywag revealed Wales had a personal relationship with Marsden, and posted supposed transcripts of their instant message conversations on its site, www.valleywag.com. Wales and Marsden met in February, and The Times reported that “An apparent transcript of their conversations before that meeting suggests that, although Mr Wales had withdrawn from the editing process, he was still influencing the editors.” The Times quoted Wales from the chat logs as having stated to Marsden “The truth is of course a much worse conflict of interest than that; but that will do.” — in reference to his conflict of interest regarding Marsden’s article on Wikipedia.

Wales posted a public statement on Saturday on Wikipedia addressing the matter, and stated that his relationship with Marsden was over: “First, while I find it hard to imagine that anyone really cares about my sex life, the facts are: I am separated from my wife. I considered myself single at the time of my one meeting with Rachel Marsden on Feb. 9, 2008 … I am no longer involved with Rachel Marsden. Gossipy stories suggesting that I have been in a relationship with her ‘since last fall’ are completely false … I care deeply about the integrity of Wikipedia, and take very seriously my responsibilities as a member of the board and as a member of the Wikipedia community. I would never knowingly do anything to compromise that trust.” With regard to the conflict of interest in Marsden’s article, Wales had acknowledged to a team of Wikipedia editors in February 2008 that he and Marsden “became friends … and that we would be meeting about that,” and stated “I recused myself from any further official action with respect to her biography.”

On Sunday, The Canadian Press reported that Marsden had posted photos of herself on Ebay, and was selling items that Wales had left at her New York City apartment. In her Ebay posting, Marsden stated: “Hi, my name is Rachel and my (now ex-) boyfriend, Wikipedia founder Jimmy Wales, just broke up with me via an announcement on Wikipedia … It was such a classy move that I was inspired to do something equally classy myself, so I’m selling a couple of items of clothing he left behind, here in my NYC apartment, on eBay. Jimbo was supposed to come visit me in a couple of weeks and pick up some of his stuff, but obviously that won’t be happening now.” Marsden told The Canadian Press “It didn’t really help matters that Jimmy chose to announce the breakup to the entire world via Wikipedia (which apparently now is an online encyclopedia that doubles as a personal soapbox?) rather than to me directly (which he did much later, in an instant message discussion).”

Marsden placed a t-shirt and sweater which she said were left at her apartment by Wales up on Ebay, and started the bidding for each at ninety-nine cents, with the auctions set to end on March 12. By Monday, bidding on the t-shirt had reached US$300, and by Tuesday the highest bid had reached $12,200. In an email to The Globe and Mail, Marsden stated “My only focus right now, to be really honest, is on my career and finding a way to get back into print, TV, or radio here in NYC,” she wrote. “All of this other personal stuff is just an unfortunate distraction.”

Jay Walsh, the Wikimedia Foundation’s head of communications, told the San Jose Mercury News that Wales’ actions in relaying Marsden’s concerns about her Wikipedia article to a team of trusted editors was within his “routine” role. When asked by the San Jose Mercury News if Wales’ actions regarding the Marsden article could compromise his role with the Wikimedia Foundation and Wikipedia, Walsh responded “No, absolutely not.”

On Tuesday, ABC News carried a story by Wired News reporter Megan McCarthy regarding allegations of “excessive spending” by Wales, and Associated Press also reported on questions involving Wikimedia Foundation expenses. McCarthy reported that former Wikimedia executive Danny Wool, who had left the foundation last year, criticized Wales’ use of Wikimedia Foundation expenses in a blog post. Wool stated that Wales had tried to expense $300 bottles of wine, a $1,300 dinner for four at a Florida steakhouse, and visits to Moscow massage parlors to the foundation, and that the foundation rescinded Wales’ corporate credit card in 2006. Wool also stated that Wales paid the foundation $7,000, after being short $30,000 on receipts for expenses.

Wool told EPICENTER that “There were occasions where he used [the Wikimedia Foundation] for personal advancement under the guide [sic] of the mission. And, as someone who was in there for the mission part of it, I found that rather distressful.” Wool commented in an interview with the San Francisco Chronicle: “Originally, it was carelessness … But as things developed, it became more apparent and obvious that he was taking advantage of the foundation credit card. It was almost like his personal piggy bank.”

Jimmy has never used Wikimedia money to subsidize his personal expenditures. Indeed, he has consistently put the foundation’s interests ahead of his own.

In an instant message exchange with Associated Press, Wales denied that the Wikimedia Foundation had taken away his corporate credit card, and asserted that he had made the decision to stop expensing business travel for the foundation. Wales highlighted a statement by the foundation’s executive director Sue Gardner: “Jimmy has never used Wikimedia money to subsidize his personal expenditures. Indeed, he has consistently put the foundation’s interests ahead of his own.” In an email to Associated Press, Brad Patrick, a former attorney for the Wikimedia Foundation, stated “Danny seems interested in blogging his way straight to a lawsuit”.

Florence Devouard, who chairs the Wikimedia Foundation, told Associated Press that Wales had been “slow in submitting receipts,” and that the foundation had rejected Wales’ expense at the Florida steakhouse. Devouard told fellow foundation board members in a private email that she had convinced Associated Press that “the money story was a no story,” and told Wales “I find (it) tiring to see how you are constantly trying to rewrite the past. Get a grip!” Wales told Associated Press: “The board, the current executive director, the previous executive director, and independent auditors have reviewed our books and publicly agree that all of my expenses were appropriate and fully accounted for.”

Media reports speculated on how the controversy would end up being represented in Wikipedia itself. On Wednesday, the St. Petersburg Times wrote: “Wales’ Wikipedia page said only this about Marsden: ‘Wales had a brief relationship with Canadian journalist Rachel Marsden.'” An article in The Australian surmised: “History will decide whether Mr Wales broke his own principles, but before that happens there may well be a Wikipedia page devoted to the controversy.”

The Wikimedia Foundation has received a copyright infringement claim from The Church of Jesus Christ of Latter-day Saints, widely known as the Mormon Church or LDS Church. The infringement claim is in reference to a URL used as a source in a Wikinews article about Mormon Church documents leaked to the website Wikileaks, titled “Copy of handbook for leaders of the Church of Jesus Christ of Latter-day Saints obtained by Wikinews”. The URL was originally cited as a link in the sources subsection of the article. The Wikimedia Foundation is a donor-supported non-profit organization which runs Wikipedia and Wikinews. This is the first time that the Wikimedia Foundation has received a copyright infringement claim regarding an article published by Wikinews.

The Wikinews article, originally published on April 19, described material in the Church Handbook of Instructions. The work is a two-volume book of policies and is a guide for leaders of the Mormon Church. Wikinews obtained the Church Handbook of Instructions from Wikileaks, a whistleblower website which publishes anonymous submissions of sensitive documents while preserving the anonymity of its contributors. Wikileaks describes the material as significant because “…the book is strictly confidential among the Mormon (Church of Jesus Christ of Latter-day Saints, aka LDS in short form) bishops and stake presidents and it reveals the procedure of handling confidential matters related to tithing payment, excommunication, baptism and doctrine teaching (indoctrination).”

The material was released on the Wikileaks website on April 16, and according to the site was first made available on the document sharing website Scribd. A message at Scribd now states: “This content was removed at the request of copyright agent B. S. Broadbent of the Intellectual Property Division of the Church of Jesus Christ of Latter-day Saints.”

On May 5, the Wikimedia Foundation received a copyright infringement claim from Intellectual Reserve, Inc., the legal entity that owns the intellectual property of the Mormon Church. The infringement claim is addressed to Jimmy Wales, the designated agent of the Wikimedia Foundation, and requests that access to the link to Wikileaks be removed. The link was removed from the article on May 5 by a Wikinews administrator, and the article remains available without the link. The infringement claim was sent by Berne S. Broadbent, president of Intellectual Reserve, Inc. and director of the Intellectual Property Division of The Church of Jesus Christ of Latter-day Saints. According to Mike Godwin, general counsel for the Wikimedia Foundation, the Mormon Church has not filed a Digital Millennium Copyright Act (DMCA) notice with the foundation.

In 1999, Jerald and Sandra Tanner, prominent critics of The Church of Jesus Christ of Latter-day Saints, released material from the Church Handbook of Instructions to the Internet through their organization Utah Lighthouse Ministry, without including the copyright notice of Intellectual Reserve, Inc. or obtaining permission from the church. The website of the Utah Lighthouse Ministry describes as its purpose: “…to document problems with the claims of Mormonism and compare LDS doctrines with Christianity.” The Tanners had received a copy of the 1998 edition of Church Handbook of Instructions from an anonymous sender in October 1999. They published 17 pages of the 160-page handbook on the Utah Lighthouse Ministry website.

The church sent the Tanners a letter threatening a copyright infringement lawsuit if the material was not removed, and the Tanners removed the material from their site the same day, and posted the church’s letter to their website. The website still contained links to other locations that had the material, and an article in the Salt Lake Tribune listed addresses of these links. The church sued the Tanners through its company Intellectual Reserve, in the 1999 case Intellectual Reserve v. Utah Lighthouse Ministry.

The plaintiffs filed their complaint on October 13, 1999, and the United States district court issued a preliminary injunction on December 6, 1999 barring posting of the material by the defendants as well as posting links to other websites which contain the material. The New York Times and other news publications called the injunction a “chilling effect“. In November 2002, the church dropped the lawsuit against Utah Lighthouse Ministry, on condition that the Tanners destroy all copies of the Church Handbook of Instructions, and not include more than 50 words at a time from the handbook in any of their future articles.

WikiLeaks will not remove the handbooks, which are of substantial interest to current and former mormons. WikiLeaks will remain a place were people from around the world can safely reveal the truth.

Wikileaks has received copyright infringement claims from organizations including the Church of Scientology‘s Religious Technology Center and the Swiss Bank Julius Baer, and the Chinese government attempts to censor every website with the word “wikileaks” in the web page address. Bank Julius Baer sued Wikileaks after sending cease and desist letters in January 2008 which cited the Digital Millennium Copyright Act. As a result of the lawsuit, the bank obtained an injunction preventing the site’s domain name registrar from associating with Wikileaks, but this injunction was lifted in March 2008 and Bank Julius Baer dropped the case.

As of May 13 Wikileaks had not taken down the material on the Church Handbook of Instructions, and a second webpage at the site with a different version of the material was also still available. In a statement to Wikinews, a Wikileaks representative commented on the material hosted at the site: “WikiLeaks will not remove the handbooks, which are of substantial interest to current and former Mormons. WikiLeaks will remain a place where people from around the world can safely reveal the truth.”

Six-year-old Thomas David Horne from the United Kingdom has died and eleven other British tourists were injured Friday when their plane crashed in Canaima National Park in Venezuela. They were on a sight seeing tour of the world’s tallest waterfalls, the Angel Falls.

The single engine, nine-seater Cessna 208 Caravan, lifted off shortly before the end of the runway, lost power, and then surged briefly before plummeting into the Venezuelan jungle in front of the 3,200 ft falls.

“It started to take off and we sensed it was losing power. Then it seemed to get it back and lifted off just 200 metres before the end of the runway. Then it dived into the trees,” reported Makeli Freire, a park tour guide.

Three of the injured sustained serious injuries, while the others suffered mainly broken bones. Thomas Horne, who sustained serious head injuries, died on the way to a local hospital. The pilot, co-pilot and tour guide were among the injured. Everyone on board was flown to Ciudad Bolívar, the capital city of Venezuela’s Bolívar state, where they were treated for their injuries. Among the injured were Thomas’s mother and father Jane and David who were among those who had broken bones. They were British tourists finishing up a two week holiday to Venezuela.

“The young boy died as he was being flown to hospital. His parents are both physically OK but are completely distraught over the loss of their son,” said Maiker Puga, of the Ciudad Bolivar clinic.

Liz and her husband Keith Grainger and S. Phillips, also British tourists, were also injured in the crash. The names of the three other British tourists and the three person crew who were injured have not been released at this time.

The plane tour was offered by First Choice, a division of TUI Travel PLC who extended their “heartfelt sympathy to family and friends during this deeply sad time.” LTA airline has suspended further flights until the investigation is concluded.

June Holman, Thomas’s aunt who was not on holidays said, that “there is nothing worse than losing a loved one, especially not a young child with their whole life ahead of them. The thoughts of us all are with his parents Jane and Dave at this very sad time.”
