ACTA rejected by European Parliament; protesters rejoice

Friday, July 6, 2012

The proposed Anti-Counterfeiting Trade Agreement (ACTA) was defeated in a plenary session of the European Parliament with 478 votes against versus 39 supporting; 165 parliamentarians chose to abstain.

Pressure and activist groups across Europe celebrated the defeat of the legislation, attributing their success to mobilising the public to bring pressure to bear on MEPs. In thanking supporters, the UK’s Open Rights Group (ORG) cautioned that Karel de Gucht, current European Commissioner for Trade, deferred any decision as to how the Commission will move forward until after a ruling from the European Court of Justice on ACTA’s compatibility with European law.

The controversial copyright- and trademark-related trade agreement previously provoked massive rallies and demonstrations across Europe. A petition against ACTA accrued two million signatures. In an editorial on the resounding defeat, where MEPs held up placards post-vote which read “Hello Democracy Goodbye ACTA”, The Guardian’s technology editor Charles Arthur said the agreement “didn’t stand a chance”. Arthur pointed out that some of the counterfeiting problems ACTA was, in part, supposed to address are ones which should concern people, particularly the risks associated with fake drugs. However, with the vague wording of the trade agreement raising the possibility of travellers’ electronic devices being searched for copyright-infringing content at customs and border checkpoints, he concluded the secretly-negotiated deal “never stood a chance against the internet tidal wave” of opposition.

Arthur also highlighted that secrecy surrounding the drafting of ACTA encouraged widespread public opposition; negotiations began under the presidency of George W. Bush, which rebuffed requests from the Electronic Frontier Foundation stating that all but ten of 800+ pages of related material were “classified in the interest of national security”. Following Barack Obama taking office, another Freedom of Information request was filed; again, access was denied with the Obama administration asserting that national security concerns justified the entire draft and related documents remaining secret.

“ACTA has become a symbol for policy made in secrecy”((de))German language: ACTA ist ein Symbol für Politik im Hinterzimmer geworden, stated Sebastian Nerz, vice-president of the Pirate Party of Germany. “We are hopeful now that Brussels has taken a stance against lobbyist interests. Upholding fundamental rights and civil liberties online seems no longer to be merely empty words for the European Members of Parliament.”((de))German language: Dass sich Brüssel nun gegen die Interessen der Lobbyisten stellt, gibt Hoffnung. Die Wahrung der Grundrechte und Bürgerfreiheiten im Netz scheint zumindest für die Abgeordneten des Europäischen Parlaments nicht nur ein leeres Wort.

Protesters criticised the vague wording and legal uncertainty ACTA would have introduced. Widespread censorship of the internet and curtailment of freedom of speech were feared; patent regulations were highlighted as having potentially adverse impact on access to medicines and crop seeds. The trade agreement, which US-based pressure group Accessnow.org described as “giving the U.S. a structural competitive advantage over other countries”, had already amongst its signatories Australia, Canada, Japan, Morocco, New Zealand, Singapore, South Korea, and the United States.

The long-running campaign against ACTA can in part be traced to publication of a leaked draft of the agreement on whistleblowing site Wikileaks. Their analysis concluded one part of the document was “a ‘Pirate Bay killer’?”, and the then-leaked draft would force internet service providers to provide “perfunctionary[sic] disclosure of customer information” and would “likely outlaw multi-region CD/DVD players.”

Defendant shoots Judge, three others at Atlanta courthouse

Friday, March 11, 2005

A defendant on trial for rape in Atlanta, Georgia reportedly stole a deputy sheriff’s handgun and used it to shoot the judge, court reporter, and two deputies Friday morning. Three people were killed and one was wounded.

Fulton County Superior Court Judge Rowland W. Barnes has been confirmed dead along with the court reporter and one of the deputies. After the shootings, the suspect reportedly attempted to carjack several cars in a bid to escape. He attempted to carjack a green Honda Accord with license plate 6584-YN, from a newspaper reporter, but eventually fled by other means. The reporter in question, Don O’Briant from the Atlanta Journal-Constitution, was beaten by the suspect but was fortunate to receive only cuts to his face and a broken face from a fall.

The car was listed as being used by the suspect in public alerts across the area before it was realised that the car was in fact still in the garage of the courthouse.

The suspect has been identified as Brian Nichols, 34, who was facing a retrial for rape and kidnapping after the first trial ended with a hung jury. Police are desperately searching for Nichols, as he is considered armed and dangerous.

The suspect reportedly stole the handgun by overpowering a deputy sheriff while he was being taken into the courtroom by the deputy, said Assistant Police Chief Alan Dreher. He then shot and critically wounded the female deputy, went to the courtroom where his trial was due to take place, and held about a dozen people at bay there before killing the judge and court reporter. He later shot and killed another deputy outside.

The deputy from whom Nichols stole the handgun is now sedated and in critical condition after surgery and has a bruise in her brain, according to Jeffrey Salomone, an attending trauma surgeon at Grady Memorial Hospital. Although she was shot in the head, the bullet did not penetrate her skull, said Salomone.

Death toll from Borneo bridge collapse reaches eleven

Monday, November 28, 2011

The death toll from the weekend suspension bridge collapse on the Indonesian island of Borneo has risen from four to eleven. Search and rescue teams continue to look for bodies in the Mahakam River.

The number of wounded is currently 39 injured; reports from locals suggest 33 people remain missing at the scene in East Kalimantan’s Kutai Kartanegara district, where “Kalimantan’s Golden Gate Bridge” linked the towns of Tenggarong and the regional capital, Samarinda. A six-month-old baby is among the dead.

Cars, motorbikes, and buses all fell into the Mahakam River when the bridge came down during repairs. Another car was left overturned and balanced upon wreckage over the water. State-owned builders PT Hutama Karya completed the bridge about a decade ago in the image of California’s Golden Gate Bridge. A cable on the 720-metre structure is thought to have failed as workers dealt with it; six of the repair crew were reported missing yesterday. It had been the longest suspension bridge in Borneo.

Eyewitnesses described heavy traffic at the time of the collapse, and one survivor said he left his truck to investigate a traffic jam. Some people were left trapped by debris as the bridge came down. “It happened so fast, only about 30 seconds,” according to National Disaster Management Agency spokesman Sutopo Nugoroho.

National search and rescue head Daryatmo said yesterday cranes will attempt to move debris today, with new reports saying echo-sounding equipment will be used to check it is safe to begin lifting. It is believed the bodies of more victims will be found trapped in vehicles beneath the water, which is 35-40 metres deep. Visibility is poor, and one official explained authorities are still unsure how many vehicles are on the riverbed.

“The above-water search is continuing, but underwater operations have not been carried out because we’re worried that the bridge’s pylons are unstable and could collapse any time,” said Nugoroho today. He explained that bodies had washed onto the riverbanks overnight and were recovered today.

The president, Susilo Bambang Yudhoyono, has sent three ministers to the site to investigate the accident, while Bambang Widaryatmo, head of East Kalimantan’s police, promised “parties found to be negligent will be prosecuted”. The government has promised a replacement ferry service. The river is closed to boats as rescue operations continue, and a 22-strong team has been dispatched from the national police, comprising six forensics experts, five disaster victim identification specialists, and eleven investigators. They are there to augment the East Kalimantan Police. Health Minister Endang Rahayu Sedyaningsih yesterday visited survivors in Parikesit Hospital and promised them medical treatment at government expense.

Some people swam ashore after falling, with the aftermath filled with screams. Survivor Syakrani, 24, yesterday asserted “The authorities should have closed the bridge if it was under repair.” His words were followed by a Jakarta Globe editorial declaring the accident “unacceptable”.

The Globe went on to comment upon suggestions corruption may have played a role; “It is too early to point fingers and look to place blame, but if shoddy materials were used in the building of the bridge, those responsible must answer to the public.” Another suggestion is coal barges striking the bridge may have weakened it. Local coal company Harum Energy lost five percent of its share value today amid fears the river blockage will hamper their ability to ship coal.

Samarinda’s seen a population and construction boom lately. A few years have seen the population triple and the construction of a large mosque, and a sports stadium; an airport and port are set to follow. However, the Corruption Eradication Commission warns 70% of the corruption it investigates concerns government contracts and up to 40% of money earmarked for infrastructure ends up stolen.

Wednesday, June 7, 2006Rahul Mahajan, the son of slain Bharatiya Janata Party leader Pramod Mahajan, who was arrested on Monday under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, was remanded to two-day police custody by a Patiala House court in New Delhi on Tuesday.

Mahajan was discharged from Apollo Hospital and brought to the Tughlaq Road police station in a wheelchair. He was later produced in the court. Though the police wanted a five-day custody, the court granted only two days.

Subsequently, Mahajan was taken to the police station for interrogation. He was reportedly confronted with the other accused, Sahil Zaroo, who is also in police custody till June 12.

Zaroo was arrested in Srinagar on June 3 for allegedly purchasing and supplying drugs to the 7 Safdarjung Road bungalow in the early hours of June 2. He has allegedly disclosed to the police that he bought drugs at the instance of Mr. Mahajan’s personal secretary Bibek Moitra, who subsequently died. The police also questioned Mr. Mahajan’s erstwhile aide, Harish Sharma, to find out if he had any role to play in destruction of evidence at the scene of crime. Additional Deputy Commissioner of Police (New Delhi) Manish Aggarwal said they were also probing the role of the three domestic help.

Floating Vs Fixed Interest Rates How Loans Work

Floating vs fixed interest rates How loans work

by

zameenkuldeep

There are two interest payment options you can choose from when applying for a home loan -fixed rate and floating rate.

A fixed rate is where the rate of interest is fixed throughout the tenure of the loan. Generally, most banks keep the rates fixed for a maximum of 5 years.

A floating rate is where the rate of interest is benchmarked against a specific interest rate (usually the bank’s internal rate), and fluctuates according to the benchmark.

Usually, you can strike a floating rate loan at a lower rate than a fixed rate loan, the difference being around 1 to 2 per cent.

If the interest rate of a

floating rate loan

rises, banks first increase loan term or the duration of the loan.

Otherwise, they can even increase the amount of your EMI.

Which rate to choose?

Keep the following factors in mind while deciding whether to opt for a fixed rate or floating rate: Outlook: When interest rates are high, it makes sense to go in for a floating rate loan, as a fall in rates will benefit you. And if interest rates are low, it is advisable to lock in a lower fixed rate for at least 3-5 years.

Stage of life: If you are a senior citizen, or somebody with a fixed source of income, you cannot afford an increase in EMI and should go for a fixed rate loan.

Fixed rate loans

are not fixed In the world of finance, nothing is certain, especially where the loan segment is concerned. There is a lot of fine print that has to be read carefully before any decision is made because it can come back to haunt the person at some later stage. Investors as well as borrowers in India have experienced this in the last few years and hence this area needs extra attention.

In common parlance, the term fixed rate loan can be distinguished from the floating rate loan on the basis of the manner in which a borrower will pay interest on the loan. In a floating rate loan, the rate paid is linked to some other rate, usually a benchmark rate, fixed by the lending institution. Changes in an economy have an impact on the benchmark rate and the borrower also experiences a change in the rate that he/she will pay. As opposed to this a fixed rate loan will have a fixed rate of interest to be paid on it.

Many people believe that the rate of interest once fixed remains fixed for the entire duration of the loan. This is what is supposed to happen but some clauses in the

loan agreement

render this false.

This means that the fixed rate will also change; the only difference will be the frequency at which it will change.

There are two factors that lead to a change as far as the fixed rate is concerned. In many agreements, the rate is fixed for only a specific duration of time. This time period can be of three years or five years and the rate of interest can change after this period is over. After this the lender can once again fix the rate for some additional time duration and this will be done based upon the situation prevailing at that point of time. So, if there has been a rise in the rates due to some reason, the fixed rates will be revised upwards and the individual can get trapped because the higher rates will then be applicable for the next fixed time period.

This can also happen through a clause that says that in case of an emergency situation in the economy or massive disruptions in the debt market, the rate of interest might change. What this situation will be is not clearly defined and is open to interpretation. Due to this reason borrowers will always be on the edge. In the event of such a situation, the loan will no longer have the characteristics that the borrowers believed were present initially.

A word of caution All banks lend floating rate loans at a discount to a benchmark rate called `Prime Lending Rate’ (PLR). This benchmark rate and the amount of discount are an internal matter for a bank, and this can affect a customer.

Let’s look at the movement of PLR and average discount of some private banks: The rates have increased from 8 to 12 per cent in around three years.

While the rates of interest for a new customer have fallen, those for the old customers are still increasing.

Chances are that the discounts can go on increasing, but the PLR will not fall.

So, if you want to avail of better rates, go in for prepayment and take a new loan. It might be worthwhile in spite of the 2 per cent prepayment fee.

Most private banks have increased the interest rates heavily, whereas public banks have been much more moderate.

How good is

fixed-cum floating interest rate

?

Borrowers always find it difficult to choose between a fixed rate loan and floating rate loan, and in recent years, they have to consider one more option -fixed floating rate loan.

In this loan type, the interest rate is fixed for an initial period, which later gets converted to a floating one.

What should a customer do? Consider the impact beyond year one while taking the loan. If interest rate for a new loan is deliberately kept low to attract customers, any change can lead to a spike in the EMI. This will mean a large discount in the first year on the prevailing interest rate. The rates might not conform to the rising trend of interest rates in the future.

“Junk” foods may affect aggressive behaviour and school performance

Dr. Stephen Schoenthaler, a Professor of Criminal Justice at the California State University in Stanislaus, has long argued that there is a link between a healthy diet and decreased aggressive behaviour, as well as with increased IQ and school performance.

Dr. Schoenthaler is well-known for a youth detention center study where violations of house rules fell by 37% when vending machines were removed and the cafeteria replaced canned food by fresh alternatives. He summarizes his findings by saying that “Having a bad diet right now is a better predictor of future violence than past violent behaviour.” In a very large test, Schoenthaler directed a study in meals at 803 New York City schools, in low-income neighbourhoods, finding that the number of students passing final exams increased by 16%.

Critics have questioned some of Dr. Schoenthaler findings, due to the lack of placebo control groups. However, more recent work by Dr. Bernard Gesch, a physiologist at the University of Oxford, has placed some of the work on a more scientific footing. Dr. Gesch found that nutrition supplements produced a 26% drop in violations of prison rules over a placebo, and a 37% decrease in violent offences. The Netherlands has embarked on a wider scale dietary research program in 14 prisons.

The short term behaviour consequences of ingesting sugar are well understood: an initial burst on energy, followed a sugar low in which your body produces adrenalin, which makes you irritable and explosive. However, Schoenthaler and Gesch suggest that there are long term impacts over and above the short term consequences of blood sugar variations.

Despite having over 1,300 locations more than Wendy’s, Burger King bumped down to the number three ranking of United States hamburger chains. In 2011, Wendy’s sales came out on top with $8.5 billion with Burger King close behind at $8.4 billion.

Wendy’s edged Burger King out of the number two spot for the first time since Dave Thomas founded the company in 1969.

McDonald’s still holds the number one spot, squashing both Wendy’s and Burger King with sales of more than $34 billion from 14,098 U.S. locations. Around the globe, Burger King clutches onto the number two ranking among hamburger joints.

Since 2006, the restaurant business has had a make-over in the top five competitors. According to Technomic, the top three restaurant chains used to be comprised entirely of hamburger chains: including McDonalds, Burger King and Wendy’s, respectively. Today, Subway is ranked second with $11.4 billion — a 48 percent jump, with Starbucks right behind with $9.8 billion — a 39 percent jump.

According to Technomic, Five Guys Burgers and Fries is creeping up on the other chains by making the largest leap last year.

City to sue owner of partially collapsed 19th century livery in Buffalo, New York

Buffalo, New York —Two weeks after a 19th century stable and livery on Jersey Street partially collapsed and caused 15 homes to be evacuated in Buffalo, New York, residents still do not have answers from the city despite a court order to work with them and come to an agreement on a way to save some or all of the building, Wikinews has learned. Despite the frustration from residents, the city is planning on suing the building’s owner. A rally was held at the stable’s site where residents are hoping to bring more awareness to the situation and gain more support to save the building.

On June 11, a significant portion of the stable’s right side wall collapsed into the yard of a resident’s home. Authorities, including the Buffalo Fire Department were called to the scene to evaluate the collapse and evacuate 15 homes of residents surrounding the stable as a precautionary measure. The following day, the city ordered an emergency demolition on the building, which was stopped by a restraining order residents with Save The Livery (www.savethelivery.com) won on June 14. Two weeks later, five homes are still evacuated and residents don’t know when they will be able to return.

On June 19, Judge Justice Christopher Burns of the New York State Supreme Court ordered a halt to the emergency demolition and ordered the city and residents to come to an agreement to save the building, or at least a significant portion of it. Despite a court date today, no agreement has yet been reached between the two parties.

“It is in the interest of the city to have a safe environment–but also important to maintain a sense of historical preservation,” stated Burns in his June 19th ruling. The court ruled that a limited demolition could take place and that the city was only allowed to remove material in immediate danger to residents and pedestrians, but stated that the demolition could only be performed with “hand tools.” The court also ordered that any rubble which had fallen into neighboring yards when the building collapsed, to be removed. Since then, most of not all the significantly damaged portions of the building or portions in immediate danger of falling have been demolished. The roof has also been removed to put less stress on the stable’s walls.

“Its been over three years since we have been having problems with part of the livery falling down. There was an implosion two weeks ago and suddenly the city wanted to have an emergency demolition,” said Catherine Herrick who lives on Summer Street immediately behind the stable and is the main plaintiff in the lawsuit against the city. Many homes on Summer are small cottages which were used as servants quarters when the stable was in operation, many of which were built in the 1820’s. At least seven homes on Summer border the stable’s back walls. Residents in those homes have significant gardens which have been planted against the building and growing for decades.

“Both parties are to continue to work together to see how we can meet everybody’s needs. This is the third time we have been in that courtroom, and that is what we were basically told to do,” added Herrick who said the rally was held today because this “is Buffalo’s history. Buffalo is a wonderful place to live because of its history and this is a historical, beautiful building and we need to keep those beautiful buildings.”

Herrick states that the city is working with residents, but also believes that its “slow moving” and they are allowing the owner to get away with neglect on the property.

“I believe right now that they are letting the owner get off. The owner was negligent for 20 years, and hasn’t done anything to it despite what he has claimed to say. Now that this is an emergency situation, the city has a lot to say about it,” added Herrick.

Currently the building is owned by Bob Freudenheim who has several building violations against him because its poor condition. He has received at least five violations in three months and residents who live near the building state that Freudenheim should be “100% responsible” for his actions.

Freudenheim gave the city permission to demolish the building on June 12 during an emergency Preservation Board meeting, because he would not be “rehabilitating the building anytime soon.” Freudenheim, along with his wife Nina, were part-owners of the Hotel Lenox at 140 North Street in Buffalo and were advocates to stop the Elmwood Village Hotel from being built on the Southeast corner of Forest and Elmwood Avenues. They also financially supported a lawsuit in an attempt to stop the hotel from being built. Though it is not known exactly how long Freudenheim has owned the stable, Wikinews has learned that he was the owner while fighting to stop the hotel from being built. Residents say that he has been the owner for at least 22 years. Attorneys for Freudenheim confirm that the city is starting proceedings against him for his violations beginning as early as Wednesday June 25. Freudenheim has not released a statement and could not be reached for comment.

Many residents want the building preserved and Herrick states that their engineer can have it stable in “four days” as opposed to the 14-30 days it would take to demolish the building and “at a lesser cost than what it costs to demolish it.”

It will cost the city nearly US$300,000 to demolish the building which is paid for with tax money collected from residents in the city. The Buffalo News reports that fees are approaching $700,000. Though reports say there is a potential buyer of the stable, Wikinews cannot independently confirm those reports.

Residents say the stable was designed by Richard A. Waite, a 19th century architect, and was first owned by a company called White Bros., used as a stable and housed at least 30 horses at any given time. It also stored “coaches, coupes, broughams, Victorias and everything in the line of light livery,” stated an article from the West Side Topics dated 1906. According to the article, The company first opened in 1881 on Thirteenth Street, now Normal Avenue, and later moved into the Jersey building in 1892. The Buffalo Fire Department believes the building was built around 1814, while the city property database states it was built in 1870. It is believed to be only one of three stables of this kind still standing in the country.

At about 1950, the stable was converted into an automobile body shop and gasoline station.A property record search showed that in 1950 at least four fuel storage tanks were installed on the property. Two are listed as 550 square feet while the other two are 2,000 square feet. All of the tanks are designated as a TK4, which New York State says is used for “below ground horizontal bulk fuel storage.” The cost of installing a tank of that nature according to the state, at that time, included the tank itself, “excavation and backfill,” but did not include “the piping, ballast, or hold-down slab orring.” It is not known if the tanks are still on the property, but residents are concerned the city was not taking the precautions to find out.

Wikinews has called the city along with the Mayor’s office several times, but both have yet to return our calls. There are conflicting reports as to the date of the next hearing. According to Herrick, the next hearing is July 1, 2008 though the Buffalo News states the next hearing is July 8. The News also states that Burns will make a final ruling on the stable at this time.

A U.S. citizen working for the U.S. Embassy in Afghanistan was killed by an Afghan also working there. The incident took place in the CIA Annex of the U.S. Embassy at Ariana Hotel in Kabul. The victim was not named.

A second person injured in the incident was sent to a military hospital. The lone attacker was also killed. A senior Taliban commander stated that the attacker had secretly joined the insurgents after a group of Taliban approached him to remind him “of his moral and religious duty as an Afghan.”

U.S. officials have stated that an investigation on the incident has started.
