Small Texas town hosts large baseball tournament

The Texas city of Chandler, with a modest population of just over 2,700, is hosting the Texas Teenage Baseball-Softball Association’s 8U [age 8 and under] Boys State Tournament. The event’s opening ceremony was held on Sunday July 22nd. Some of the city’s citizens have expressed excitement about and anticipation of the tournament for several weeks.

Including players and coaches, about 800 people attended the opening ceremonies, which began at 7pm CDT at the Winchester Park baseball complex and were led by the city’s Mayor, Ann Hall. Local businesses sponsored a hotdog supper at the complex before the ceremony. Overall, the tournament is to feature all 17 teams competing in about 40 games. Games are set to start at 8:30am each day, and play through 11:00pm nightly.

During the opening ceremony, teams lined up along the main competition field and each player and coach received a souvenir bag provided by the city of Chandler. The lead-up to the ceremony also featured a Kids Zone area with water slides, and bounce houses and a dunking booth staffed by coaches from the visiting teams.

The city’s major, Ann Hall, welcomed the team to Chandler and wished them salutations during their tournament play.

Bush’s Katrina statement contradicted by emerging evidence

Recently emerging evidence seems to contradict a statement by United States President George W. Bush during Hurricane Katrina. He stated in an interview with ABC on September 1st that, “I don’t think anybody anticipated the breach of the levees”.

One of the first items to emerge, a video obtained by the Associated Press, shows footage of Bush during a video-conference received at his ranch in Crawford, Texas, on August 29, 2005, 19 hours before landfall of Hurricane Katrina. During the briefing, Director of the National Hurricane Center Max Mayfield warned, “I don’t think anyone can tell you with any confidence right now whether levees will be topped or not, but there is obviously a very, very great concern”.

In addition, Michael D. Brown, then director of the Federal Emergency Management Agency (FEMA), reported that he had spoken with President Bush twice in the morning and that the president was asking about reports that the levees had been breached.

Brown would state later on CNN that, “There’s no question in my mind he probably had those reports (about breaches in the levees), because we were feeding in the Homeland Security Operations Center, into the White House sit room, all of the information that we were getting. So he had to have had that information. Plus, I think the president knew from our earlier conversations that that was one of my concerns, that the levees could actually breach”.[1]

In July 2004, the Federal Emergency Management Agency completed an exercise called “Hurricane Pam”, which, dealt with the scenario of a direct hit on New Orleans by a hurricane with 120 mph winds (a Category 3). It resulted in “10 to 20 feet of water within the City of New Orleans,” according to January 24 congressional testimony by the president of the company that designed the Hurricane Pam exercise.[2]

A report FEMA sent to the White House Situation Room on August 29th, they cited death and destruction anticipated by the “Hurricane Pam” exercise and warned that Katrina was likely to be worse. “Exercise projection is exceeded by Hurricane Katrina real-life impacts,” they stated. Furthermore, “The potential for severe storm surge to overwhelm Lake Pontchartrain levees is the greatest concern for New Orleans. Any storm rated Category 4 on the Saffir-Simpson (hurricane) scale will likely lead to severe flooding and/or levee breaching. This could leave the New Orleans metro area submerged for weeks or months”.[3]

When the report was released, Hurricane Katrina was thought to be a Category 4 as of landfall (though after analysis, it’s power at landfall would be downgraded to a Category 3).[4]

White House officials previously clarified Bush’s earlier comment, saying that the president was referring to the hours after Katrina swept through and news reports as of August 30th suggested the city had “dodged a bullet”, which led to surprise when reports reached them of the levee breaches.[5][6] Contrasting this was the August 30th broadcast of NBC’s Today, NBC Nightly News anchor Brian Williams reported at 7:05 a.m. ET, “There has been a huge development overnight … the historic French Quarter, dry last night and it is now filling with water. This is water from nearby Lake Pontchartrain; the levees failed overnight.”[7]

On November 13, Toronto residents will be heading to the polls to vote for their ward’s councillor and for mayor. Among Toronto’s ridings is Toronto Centre (Ward 28). One candidate responded to Wikinews’ requests for an interview. Journalist, counselor, painter, and US 2012 Presidential candidate Joe Schriner of Cleveland, Ohio took some time to discuss his campaign with Wikinews in an interview.

Schriner previously ran for president in 2000, 2004, and 2008, but failed to gain much traction in the races. He announced his candidacy for the 2012 race immediately following the 2008 election. Schriner refers to himself as the “Average Joe” candidate, and advocates a pro-life and pro-environmentalist platform. He has been the subject of numerous newspaper articles, and has published public policy papers exploring solutions to American issues.

In a major decision, the Supreme Court of the United States has expanded the right of government to seize private property for public good by allowing the city of New London, Connecticut to invoke eminent domain and seize homeowners’ property for economic development reasons.

In a closely-divided decision, 5–4, the court determined that the city’s economic development plan constituted a “public use”, and therefore qualified under the U.S. Constitution’s fifth amendment’s Eminent Domain clause.

Justice John Paul Stevens wrote the majority decision, and was joined by Justices David H. Souter, Ruth Bader Ginsburg, Stephen G. Breyer and Anthony Kennedy. “Promoting economic development is a traditional and long accepted function of government,” Stevens wrote, and justified the decision further by saying municipal authorities are better positioned to make decisions regarding a community’s best interests than judges.

Writing the dissenting opinion, Justice Sandra Day O’Connor rejected the economic justification as a public use, pointing out that wealthy individuals are more capable of defending themselves and so are less at risk. But the greatest issue was the likelihood of abuse of eminent domain:

“The specter of condemnation hangs over all property. Nothing is to prevent the state from replacing any Motel 6 with a Ritz-Carlton, any home with a shopping mall or any farm with a factory.” A separate dissent was also included written by Justice Clarence Thomas.

Asbestos victims seeking their retribution payment of A$350 million from the Asbestos Injuries Compensation Fund are approaching the Australian government following an admission from James Hardie compensation fund trustees stating they are unable to pay the victims in lump sums due to the recession.

The James Hardie building materials firm which established the $1.5 billion fund in 2006, claims it is short 3.5 million for its compensation fund payouts due to the decline in the American housing market which provides 85 percent of its company sales. The settlement stipulates that in the event of a shortfall, victims will receive funds in the form of installments.

We’re talking to the government and James Hardie about funding options.

Asbestos advocacy groups representing injured former employees are requesting help from the Australian Prime Minister Kevin Rudd for additional funds from James Hardie. “We’re talking to the government and James Hardie about funding options,” said Dallas Booth, CEO of Asbestos Injuries Compensation Fund.

“For example victims might be able to sign over their rights to the state government so that they get compensated in full until the fund can be replenished and then the state government can get their money back straight out of the fund.” suggested Paul Bastian, New South Wales secretary of the Australian Manufacturing Workers Union .

The victims groups are totally opposed to any instalment plan whatsoever.

Barry Robson, president of the Asbestos Diseases Foundation explained that James Hardie has paid $153 million in taxes to the Australian Taxation Office, and that the Asbestos Diseases Foundation will request of the Rudd Government to defer these taxes until the economic condition improves and James Hardie’s profitability returns. In this way the Australian government would allow James Hardie’s taxes to go to the asbestos fund.

Victims are currently paid out via a lump sum arrangement, and the Asbestos Diseases Foundation is advocating for the status quo. “Well how they’re paid now is in lump sum and we’d like to continue with that. The victims groups are totally opposed to any instalment plan whatsoever,” said Robson in the interview with PM.

The Asbestos Diseases Foundation emphasized that a payment plan could be ineffectual, as asbestos victims and those suffering from mesothelioma may die before receiving full payments.

Bastian noted to the Australian Associated Press that asbestos victims have upfront costs to deal with, including medical bills, and would be adversely affected by an installment plan option. “Victims also want to ensure that their families are looked after, that there’s contingencies and everything is settled before they pass away, in many cases,” said Bastian to the AAP.

Bastian told The Australian he would request Prime Minister Rudd stay true to his promise that “no one would go without compensation”. “I think the state Government should be our white knight,” commented Bastian.
